Our practice
Morgan has a storied history as one of the nation’s leading Supreme Court and appellate litigation firms. The firm’s Supreme Court and Appellate practice is led by Kannon Morgan, a veteran of the Attorney General’s Office who has argued 35 cases before the Supreme Court and is one of the best known and respected appellate advocates in the nation.
Our attorneys regularly appear before the Supreme Court and in federal and state appellate courts throughout the country. Our appellate expertise traces the full range of our practice areas, including administrative law, antitrust, bankruptcy, class actions, criminal defense, intellectual property, mergers and acquisitions, product liability, and securities litigation. Among our string of recent Supreme Court victories, we were the lead attorneys in the historic constitutional challenge to the structure of the Consumer Financial Protection Bureau. Beyond the Supreme Court, we have an exceptional track record in the courts where major business cases are tried, including the U.S. Courts of Appeals for the 2nd, 9th, and federal circuits in D.C.; the New York Court of Appeals and Appellate Division; and the Delaware Supreme Court.
Our attorneys combine skill in crafting persuasive briefs and oral arguments with unmatched experience in the courts in which we litigate. Currently, the firm’s ranks include ten former Supreme Court clerks and more than 75 former federal appeals court clerks.
We also have an active pro bono practice at all levels of the appellate system, dating back to our involvement in Brown v. Board of Education. We were recently lead counsel in a major Supreme Court case limiting the scope of the major law that imposes mandatory minimum sentences on federal felons. We represent parties and amici in pro bono cases in a variety of subject areas, and the firm’s associates routinely present oral arguments in such cases in federal and state appellate courts.
